Statute of the Competition "Win a Flight in a Sport Airplane and Other Prizes" – Terms and Conditions of the Consumer Competition
Introduction
The company Kustom City s. r. o., Company ID (IČO): 56118678, with its registered office at Budatínska 3230/16A, 851 06 Bratislava - Petržalka borough, Slovak Republic, Company ID (IČO): 00 211 087, registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, File No.: 177012/B (hereinafter referred to as "Kustom City" or the "Organizer"), hereby announces a consumer competition titled "Win a Flight in a Sport Airplane and Other Prizes" (hereinafter referred to as the "Competition") in accordance with the terms and conditions specified in these Consumer Competition Rules and Conditions.
The consumer competition is governed exclusively by these Consumer Competition Rules and Conditions (hereinafter referred to as the "Rules").
The Competition will take place from September 19 to September 20, 2026, at the premises of the Incheba Expo Bratislava exhibition and congress centre, Viedenská cesta 3 – 7, 851 01 Bratislava, Slovak Republic (hereinafter referred to as the "Centre"). The Competition takes place within the territory of the Slovak Republic.
The 1st prize in the Competition is provided by the commercial company Falcon attack s.r.o., registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, File No. 105015/B, Company ID (IČO): 48208639. The 2nd prize in the Competition is provided by the commercial company Porsche Slovakia spol. s r.o., registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, File No. 6133/B, Company ID (IČO): 31 362 788. The 3rd prize in the Competition is provided by the commercial company SLOVAKIA RING AGENCY, s. r. o., registered in the Commercial Register of the District Court Trnava, Section: Sro, File No.: 50310/T, Company ID (IČO): 44 407 793 (hereinafter collectively referred to as the "Sponsors").
Conditions for Entering the Competition
A participant in the competition (hereinafter referred to as the "Contestant") and a winner of the Competition may be any person who fills out and submits a raffle coupon (hereinafter referred to as the "Coupon") to Kustom City (the Organizer) and who simultaneously agrees to the Rules of the Competition.
The condition for entry into the Competition is that the Contestant legibly fills in their personal details—specifically first and last name, email, telephone number, and signature—on the raffle coupon included with the admission ticket purchased on-site at the Incheba Expo Bratislava box office for the International Autoshow exhibition, and drops the completed Coupon into the raffle box located in Hall B1 of the Centre. Multiple entries into the Competition are permitted.
Duration of the Competition
The Competition runs from September 19, 2026 (9:00 AM) to September 20, 2026 (2:59 PM). To properly enter and gain participation in the Competition, all entry conditions specified in Art. II of the Rules must be fulfilled during the duration of the Competition.
Draw, Prizes, and Taxation
Submitted Coupons will be entered into a draw held on September 20, 2026, at 3:00 PM in Hall B1. The verification of entry conditions specified in Art. II of the Rules and the drawing of winners will be conducted by an employee of the Organizer. In the event that a raffle coupon is incomplete or the provided details are illegible, the draw will be repeated.
The prizes included in the consumer competition are:
a) 1st Prize: Introductory flight in a sport airplane with a professional captain and the opportunity to pilot the aircraft.
b) 2nd Prize: SCX Compact Cupra Racing electric slot car racing set in 1:43 scale.
c) 3rd Prize: Admission ticket for two persons to the OMV MAXXMOTION FIA CEZ Rallycross race (October 17–18, 2026).
Each winner will be contacted by the Organizer by phone at the telephone number provided on the raffle coupon no later than September 30, 2026. The Organizer will also provide the winners with additional instructions regarding prize collection.
Prize Handover
Prizes in the Competition will be handed over to the drawn winners as follows:
- by mail/courier in the case of prizes a) and c) pursuant to Art. IV of the Rules,
- in the case of prize b), at the premises of Porsche Slovakia spol. s r.o., Vajnorská 160, 831 04 Bratislava, pursuant to Art. IV of the Rules.
A condition for prize handover is that the winner provides Kustom City (the Organizer) with the personal data necessary to register the winner for the purpose of fulfilling the competition rules pursuant to Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter referred to as the "GDPR").
Together with the prize, the Organizer will provide the winner with a document confirming the value of the prize.
The Organizer is entitled to require that any winner under the age of 18 at the time of receiving notification of winning be represented by their legal guardian when claiming the prize; otherwise, the Organizer is not obliged to hand over the prize to the Contestant.
Prizes a), b), and c) pursuant to Art. IV of the Rules will be dispatched to the winners no later than 14 days from the date of contact between the Organizer and the winner and the provision of the required shipping details by the winner. Prizes a), b), and c) pursuant to Art. IV of the Rules that are not claimed by October 15, 2026, at the latest, will be forfeited, and Contestants forfeit their right to receive them.
Final Provisions
Kustom City (the Organizer) is not liable for any direct, indirect, incidental, or consequential damages, loss of earnings, or lost profits resulting from participation in the Competition or failure to participate, even if the Organizer was advised of the possibility of such damages. In particular, the Organizer is not liable for potential technical issues or force majeure circumstances affecting the final outcome of or participation in the Competition. Kustom City is not responsible for the fulfillment of tax or other legal obligations by the winners. The Organizer is also not liable for damages incurred by the winners in connection with the accepted prizes. Prizes cannot be legally enforced in court. The Contestant is responsible for providing true and correct personal details on the Coupon. The Organizer declares that the Competition is in no way sponsored (with the exception of prizes provided by the Sponsors), endorsed, or administered by, or associated with Facebook. Pursuant to Act No. 595/2003 Coll. on Income Tax, monetary and non-monetary prizes valued over EUR 350.00 are subject to income tax and public health insurance contributions pursuant to Act No. 580/2004 Coll. on Health Insurance. The Income Tax Act defines which prizes and awards are fully exempt from tax, the method of taxation, and who is liable for tax payment—whether the winner or the competition organizer.
Personal Data Processing Policy
The Organizer, as the Data Controller pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "GDPR"), processes personal data of participants to the extent necessary to register them in the competition, verify compliance with entry conditions, draw winners, contact winners, hand over prizes, and fulfill other obligations arising from the competition statute.
Personal data processing for competition administration purposes is carried out pursuant to Article 6(1)(b) GDPR to ensure participation in the competition and fulfill the Organizer's obligations arising from the competition statute, and pursuant to Article 6(1)(c) GDPR to fulfill the Organizer's legal obligations.
During the Competition, completed raffle coupons will be securely stored in a locked raffle box. Access is restricted to persons authorized by the Organizer who have been instructed on personal data processing and are bound by confidentiality.
Upon conclusion of the draw, the Organizer will immediately destroy all undrawn raffle coupons containing personal data, unless the participant grants consent for marketing purposes extending beyond the end of the competition. Winners' personal data will be retained for the period necessary to prove the proper conduct of the competition and fulfill the Organizer's legal obligations, but for no longer than 5 years (to demonstrate proper conduct of the competition, handle potential claims, audits, and protect the Organizer's legal claims), unless a specific legal regulation provides otherwise.
Participants' personal data is not subject to profiling or automated individual decision-making pursuant to Article 22 GDPR.
The Organizer, as Data Controller, does not intend to transfer personal data to a third country or international organization.
Personal data may be disclosed to the following categories of recipients/institutions: persons authorized to carry out activities on behalf of the company, particularly employees of the Organizer, accounting advisors/auditors, attorneys, and court bailiffs (enforcement officers).
Marketing Consent
A participant may voluntarily grant consent to the Organizer to process their personal data for the purpose of sending marketing and commercial communications pursuant to Article 6(1)(a) GDPR.
Marketing purposes primarily include sending information regarding upcoming exhibitions, events, competitions, news, products, services, discount promotions, business offers, and other marketing activities of the Organizer.
Consent is granted for a period of 5 years or until withdrawn, whichever occurs first.
Granting marketing consent is not a prerequisite for entering the competition, and withholding consent does not affect entry into the draw or the chance of winning.
The participant may revoke marketing consent at any time free of charge using the method outlined in the Organizer's Privacy Policy or via the Organizer's contact details.
The participant may also grant consent for their personal data to be provided to the Organizer's business partners under the conditions set out below in this article. Granting or withholding this consent has no bearing on competition entry or on marketing consent granted to the Organizer.
Consent to Share Personal Data with Partners
If the participant grants voluntary marketing consent regarding the Organizer's business partners, the Organizer is authorized to provide their personal data to business partners (primarily exhibitors and sponsors) of the specific event, the current list of which is published on the website www.kustomcity.sk (valid as of the date consent is granted) for the given event, or is available to the participant upon request prior to granting consent. Upon receiving personal data, the partner acts as an independent Controller pursuant to Article 4(7) GDPR and bears full responsibility for further processing.
Personal data may be provided to partners solely for the purpose of sending their own commercial and marketing offers, limited to: first name, last name, email address, and phone number.
This consent is entirely voluntary, is not a condition of participation in the competition, and may be revoked at any time. Revocation of consent does not affect the lawfulness of processing carried out prior to its withdrawal.
The Organizer will provide personal data to partners only on the basis of valid consent from the participant. Further processing by the partner is governed by the partner's own privacy policy.
Personal data will be provided to partners on a one-time basis, unless the participant grants new consent or requests further sharing.
The Organizer provides personal data to the partner solely for the purpose for which consent was granted. Further data processing by the partner is governed by their own privacy policy and generally binding legal regulations.
The Organizer is not liable for further processing carried out by the partner after transfer. Each partner is independently responsible as a Data Controller for fulfilling information obligations, establishing a legal basis, and handling data subject rights.
Data Subject Rights
The data subject has the right to:
- request access to their personal data,
- request rectification of inaccurate or outdated data,
- request erasure of personal data or restriction of processing if GDPR conditions are met,
- object to personal data processing,
- request data portability,
- revoke granted consent at any time,
- lodge a complaint with the Office for Personal Data Protection of the Slovak Republic.
The Organizer does not provide personal data to partners without the participant's prior express consent. Detailed information regarding personal data processing pursuant to Articles 13 and 14 GDPR—including controller identification details, contacts, recipients, retention periods, methods of consent withdrawal, and exercise of data subject rights—is published in the Privacy Policy on the Organizer's website at www.kustomcity.sk.
